Who Is Responsible for a Trucking/Tractor Trailer Accident?

When there’s been an accident involving a tractor trailer or a heavy truck, there’s often multiple theories of liability that can be pursued. The first is against the driver of the tractor trailer or truck, if they did something inappropriately. Perhaps they were driving carelessly or following too closely, or they were driving and they haven’t had sufficient rest, or were out of hours under the federal or state regulations. Their employer can also be held responsible for the driver’s actions.

It’s also important to look at other areas in a tractor trailer case that aren’t necessarily involved in your typical automobile wreck such as, was the wreck caused or contributed to by the shipper improperly loading the materials in a tractor trailer? If you don’t have a lawyer that knows to look at those claims and bring them on your behalf, you may not get full recovery. Because often times the injuries are catastrophic or someone has lost their life. There may be insufficient assets or insufficient insurance if you limit your theory of recovery to just one of these entities. You need to make sure you hold everyone responsible if more than one person has contributed to the wreck which has injured yourself or your loved one.
