Scaffolding Falls and Seriously Injures Worker at New Atlanta Falcons Stadium

The Atlanta Journal Constitution has reported that a construction worker at the new Atlanta Falcons stadium site suffered a severe head injury after scaffolding fell on top of him. Atlanta police, fire and EMS all responded to the scene and are investigating the matter.

Injured at Your Workplace? You May Be Entitled to More Than Workers Comp

Workplace injuries are governed by a unique set of laws and regulations. While the workers compensation system is intended to provide compensation when an employee is injured in the course of his or her employment, recovery under workers compensation laws is limited and does not include recovery for damages such as pain and suffering.

Many make the incorrect assumption that if an employee is injured on the job that only a workers compensation claim can be pursued. However, other companies than the employer of the injured worker may be at fault. In such situations, the limitation on damages provided in workers compensation cases does not apply.

Our Experience With Work Site Accidents and Injuries

Harris Lowry Manton LLP has extensive experience in investigating work site accidents and injuries. For example, after a flash fire and explosion occurred at a water treatment plant, Harris Lowry Manton was able to assist the injured individuals to recover substantial sums of money on top of workers compensation benefits. Prior to retaining HLM, the injured workers had been told by other lawyers that their only claim was for workers compensation benefits.

However, after our firm’s investigation, the injured workers were successful in pursuing their claim for full damages including pain and suffering on top of workers compensation benefits. While all cases are unique and depend on the specific facts at hand, in the water treatment plant case the ability to recover on top of workers compensation benefits resulted in millions of dollars of additional recovery.
